Dear Dr Ravi

This is to update the earlier letter.

Thanks for asking for the clarifications.

At the very outset, I would like to mention that the various emails sent by the three email ids i.e. drsprao2000@gmail.com and pcpatel930@gmail.com and cwcmembersofima@gmail.com are false, frivolous, vexatious, mischievous and the same are without any basis and record.

The emails sent by Dr S P Rao via email id  drsprao2000@gmail.com and the email sent by Dr PC Patel via email id pcpatel930@gmail.com and email sent by one M Singh via email id cwcmembersofima@gmail.com have been sent to all the recipients from the same computer and from the same IP address.

Further, there is no record of these email ids in IMA HQs, so there is no authenticity of these two email ids and the emails sent by them.

The email ids are fake and the emails sent by the said fake email ids are frivolous, vexatious and mischievous. There is no basis of the said emails and the same are mischievous in nature which have been sent with ulterior motive with sole purpose to defame my name, reputation and goodwill.  

Further, the sender of said emails while sending such frivolous and false emails to various people has addressed himself as IMA Activists. It is important to mention herein that there is no such thing / person as IMA Activists as IMA is a Registered Society duly registered under the provisions of Societies Registration Act, 1860. IMA is a national body of doctors practicing modern system of medicine and is not a political body where there are any activists.

All the emails from the said two fake email ids have been sent from one computer as the IP Address of the said emails is same.

Still once the subject has been raised by you it is better for me to put all on record.

All the answers of various questions raised in the said fake and frivolous emails are matter of record maintained by IMA Hq in the last three years. The same are part of CWC and/or CC Minutes of Meetings, Resolutions, Agenda, etc. The hard copies of the various minutes of meetings, agenda, resolutions, etc. are duly maintained and recorded in the office of IMA Hq by Sr Manager Legal. Also, the soft copies of the same are available on the website of IMA Hq.

Further, time and again, I had sent emails of my work done in 3 years tenure in IMA. There is nothing that I have hidden from IMA or its members.

Though, the answers to various questions raised are available either in hard copies maintained in IMA Hq office and/or in soft copy (digital form) on the website of IMA / emails sent by me but still I would like to address and answer each and every question as raised in these fake and frivolous emails.  

At the outset, it is pertinent to mention herein that in my 3 years tenure in IMA, I have worked towards the objects of IMA as duly enshrined in the Memorandum, Rules and Bye-laws of IMA Hq. All the workings and management of IMA Hq, has been conducted as per the Memorandum, Rules and Bye-laws of IMA Hq in which we all have great faith. Further, I have worked with full transparency and there has been no conflict of interest, in fact, all my companies, employees, staff have also worked with me for the advancement and upliftment of IMA pro bono and no money has ever been charged from IMA for the same. Also, so that there is no conflict of interest and so as to maintain transparency, all agreements were signed either by the then National President when I was HSG or by the HSG when I was the National President. Further, in all agreements it has been specifically mentioned that my companies / NGO has been working pro bonoand are providing complimentary services for which IMA has not made any payment. The same is evidenced from the financial statements and bank statements of IMA which clearly show that my companies/NGO, employees, etc. have given complimentary services to IMA. 

1: Who or what is EMEDINEXUS? Which CWC or CC Meeting resolved to sell the most valuable database of the entire Membership of IMA to them? What is the amount IMA incurred by selling it? Where is that money gone? What other advantages received by IMA from this?

Answer:

In the year 2015, 305-376 resolutions were passed in the 213th and 214th CWC meetings and subsequently the said resolutions were ratified in 2016 CWC meeting and later in 2017 CWC meeting as per which it was duly resolved and accepted that to avoid any conflict of interest eMedinews, eMedinexus, IJCP Group and Heart Care Foundation of India will provide complimentary services to IMA. The relevant extract of said resolution is reproduced hereunder: ”To, avoid any conflict of interest, eMediNews, eMediNexus, IJCP Group and Heart Care Foundationof India will provide complimentary services to IMA”.

The same was passed in every annual meeting of IMA in last three years.

It is pertinent to mention herein that in my 3 years tenure, all webcasts of IMA, live webcasts of all official meetings including CWC and CC were done by eMedinexus as a complimentary service to IMA. In fact, even this year’s 2018 IMA Mahapanchayat’s live webcast was done by the same team as a complimentary service.

During the CC meeting held in 2016 in Amritsar, I have in my Presidential Speech duly addressed and mentioned about these relationships and have specifically stated that eMedinews, eMedinexus, IJCP Group and Heart Care Foundation of India and their employees, staff have been giving complimentary services to IMA.

It is further mentioned herein that full time graphics designer, advocate, reception, web designer, conceptualizes were posted by me at IMA without any cost to IMA. 

Apart from HCFI, IJCP Group and its subsidies IMA have also associated regularly with bringing white papers with AHPI, Nathealth and joint papers with QCI, Max Healthcare and three advertisements with Ganga Ram Hospital without any cost to IMA.

 

2. Who or what is LYBRATE? How IMA is related to it? Which CWC/CC Meeting approved this relationship? Heard that family members of that so called self-claimed IDOL or IMA are partners of this company …… is it so?? What financial & other benefits received by IMA from weekly Webcast?

Answer:

In the year 2015, 305-376 resolutions were passed in the 213th and 214th CWC meetings as per which it was duly resolved and accepted that during the year 2015, IMA has received donation of Rs. One Crore from Lybrate. Lybrate was given a status of IMA digital partner. The donation was personally received by the then National President Dr. Marthanda Pillai in President Secretaries Meet which was held in Mumbai in 2015. Thus, the donation of Rs. 1 Crore was duly received and accepted in the presence of all President and Secretaries of various State Branches and Local Branches of IMA and also in the presence of all office bearers of IMA and the same was duly accepted and approved by all.

3. What is the exact financial terms & conditions of SMS & IMA Petition signing?

Answer: SMS of IMA are being sent and operated by the IT department of IMA. IMA petitions were done on IMA platform with the help of IJCP group IT team but IJCP group provided the complementary services for the same. Neither the IT team of IJCP group was never paid by IMA nor IMA paid IJCP group for any petition.  No other platforms were used. There was one full time web developer posted in IMA who was providing his complimentary services to IMA. IMA never paid any salary for any web developer nor made any payment towards the web development work.

4. Which Publication House was dealing with IMA Publications? Who is the owner? Heard that our so called Spiritual Immediate Past President….. is it right? Which CWC/CC approved it? What is the total financial dealing with our IMA? How IMA was benefitted?

Answer: The publications of IMA are published by IMA headquarters. IJCP Group only provided complimentary services for designing and lay outing only. The printing of various publications of IMA is done by IMA Hqs.

5. It is being heard that the Travel Agent who provides all the Tickets to IMA is also his relative….. is it right??

Answer: Following were and are the travel agents of IMA: Rajiv Tours & Travels; Uniglobe Indica Travels and Welgrow Travels Pvt. Ltd. None of them are related to any office bearers of IMA.

6. Whose organization is HEART CARE FOUNDATION? Which CWC/CC Meeting approved joint functioning of IMA, Heart Care Foundation & OMARON (a BP Apparatus Company)?

A: In the year 2015, 305-376 resolutions were passed in the 213th and 214th CWC meetings and subsequently the said resolutions were ratified in 2016 CWC meeting and later in 2017 CWC meeting as per which it was duly resolved and accepted that to avoid any conflict of interest eMedinews, eMedinexus, IJCP Group and Heart Care Foundation of India will provide complimentary services to IMA. Heart Care Foundation of India is a national charitable trust. The relevant extract of said resolution is reproduced hereunder:

“  To, avoid any conflict of interest, eMediNews, eMediNexus, IJCP Group and Heart Care Foundationof India will provide complimentary services to IMA”.

The same was passed in every annual meeting of IMA in last three years.

Omron ran a media awareness campaign with IMA and HCFI on asthma and hypertension, All, three campaigns were designed by IMA. There was no financial involvement of HCFI in this. The decision of public health and hygiene related agreements of IMA with Omron was duly reported to CWC and the same has been approved in 218th CWC meeting of IMA held in the year 2017. The relevant extract of 218th CWC meeting of IMA held at New Delhi in 2017 are as follows:

DECISIONS TAKEN BY THE CENTRAL WORKING COMMITTEE OF IMA AT ITS RECENTLY CONVENED218th MEETING HELD ON SEPTEMBER 23-24, 2017 AT HOTEL THE GRAND, NEW DELHI – 1st LOT

1.                  The House approved the IMA decision and action to publish Community Health related advertisements published and planned to be published in major dailies in association with relevant stakeholders. The House was informed that 14 community health related advertisements have been published in Indian Express and 4 advertisements have been published in Hindustan Times with the help of M/s. Omron.

2.                  All the public health and hygiene related agreements of IMA with companies like Omron, Hygia, State Bank Credit Cards etc. were reported to the CWC which approved all of them.

The above decision was rectified in 78th Central Council held at Mumbai, Maharastra on 27st December, 2017.

HCFI is also instrumental in getting IMA this year MOU with Asian paint. All the financial MOU is with IMA.

In FSC Meeting held on 5.6.2017 the following was decided

IMA will release series of advertisements in Indian Express to continue its fight on atrocities faced by the medical profession during the parliament sessions.

IMA FSC also passed that IMA could take the help of other associations or establishment to release social advertisements on public health

SFC also passed that IMA can take the help of Heart Care Foundation of India for raising sponsors for the social advertisements.

IMA currently is releasing public advertisements in Hindustan Times with OMRON and had released advertisement on Doctor’s Day with Medenta etc.   All the transactions to News Papers are being done via IMA.

In 2014-15 similar advertisements were released on Doctors Day and Govt. of India also released an advertisement with Photographs of Dr. A Marthanda Pillai & Dr KK Aggarwal to promote tax paying in time.

IMA NP & HSG or any other official spokesperson from IMA or other National or International organisations can release the advertisement with their photographs.

Also, it is important to mention herein that IMA can publish advertisement on public health as one of the one of the objects of IMA is to promote and advance medical and allied sciences in all their different branches and to promote the improvement of public health and medical education in India. Further, for the attainment of the said object, IMA can publish and circulate journal for the same.

Thus, in view of the above object, IMA had published various advertisements in national level newspapers thereby creating awareness among the public at large on various public health topics like Blood Pressure, Hypertension, etc. In the said advertisement, IMA is not promoting or endorsing any brand or company. IMA has also framed its policy on the same saying IMA can publish public health advertisements. 

7. Which CWC/CC Meeting has approved combined functioning of IMA, HCF & MEDANTA?

Answer: IMA has no initiative with Medanta. On Doctor’s Day Medanta did support IMA advertisement in HT.

IMA can publish advertisement on public health as one of the one of the objects of IMA is to promote and advance medical and allied sciences in all their different branches and to promote the improvement of public health and medical education in India. Further, for the attainment of the said object, IMA can publish and circulate journal for the same.

8. Members need clarification about the MOU (if it is all there) between IMA & JOHNSON & JOHNSON. How the entire amount of 2.5 Crs in 2 years has been spent or utilized in functioning?

Answer: No MOU has been signed by IMA with Johnson and Johnson. They have been releasing advertisements in IMA News, JIMA, supporting CMEs, well baby camps and guidelines on project to project basis. The details of the entire amount of Rs. 2.5 crores are available with the Finance Department of IMA and the same has also been passed in Finance Committee meet of IMA.

9. Who Inter Ministerial Committee was formed withdrawing the CWC decision of Strike? How or whether it finally helped IMA?

Answer: These were all CWC, CC and IMA action committee decisions. The then National President in consultation with the action committee took the decision to postpone the strike based on the circumstances at that time.

10. Crores of Rupees where collected from States & other sources for DILLI CHALO. Where is the Accounts?

Answer: Only few state branches contributed. The accounts are with the head- quarters and were passed in the subsequent CWC and CC. Accounts are open and should be on the IMA Website. The details of all accounts of IMA are available with the Finance Department of IMA and the same has also been discussed in Finance Committee meet of IMA.

11.  Which CWC/CC Meeting approved Renting out a portion of IMA HQ to others? What is the financial dealing?

Answer: IMA Building is looked after by a Building Standing committee with its chairman approving all decisions.

Minutes of the Meeting of Building Standing Committee of  IMA held on 11th April 2015 at Dwarka, New Delhi:  It was decided, not to extend the rental contract with M/s. C.K Associates, which expired on 30th April, 2015.  As this is translated into loss of revenue of the Building, it was decided to try to get another group/tenant who can give us better rental value of the area at better terms and conditions.  Team IMA office was authorized to take necessary steps in this regard.

Part of the building is given on rent to ARTH Business News Channel. It was given to M/s. ARTH on 1.10.2015  @ Rs.8 lacs per month as its rent.  It was given to Arth Business News Channel vide lease agreement dated 08.09.2015, however, later the Arth Business News Channel Private Limited miserably failed to pay the monthly rent, service tax, electricity bill and water charges. After much persuasion and requests and reminders, IMA decided to file a recovery suit against Arth Business News Channel for recovery of possession of the property given on rent to it and also for recovery of arrears of rent, service tax, electricity bill, water charges along with damages through IMA Advocates. The true copy of the said lease agreement has been filed with the suit before the Hon’ble High Court of Delhi. The said case was duly signed by Dr. Tandon being the Honorary Secretary General of IMA in the year 2017. However, Arth Business News Channel approached IMA and tried to have out of court settlement of the dispute and for the same Arth Business News Channel had even paid a part of outstanding rent to IMA. However, we did not withdraw the case which is pending before Hon’ble High Court as the full outstanding amount was not received till my tenure. The civil case for recovery is subjudiced in the Delhi High Court.

Further, Dr. S.N.P. Singh, Chairman, IMA Standing Committee for Building visited IMA Building on 3rd October, 2015. Further to a meeting of Chairman, IMA Standing Committee for Building with Honorary Secretary General, IMA and Dr. V.K.Monga, he was taken around the building for inspection.

·       5th floor - work in all the rooms is over. Work in Room No. 507 is still on and he was apprised about changes being made.

·       Work on 4th floor in all the rooms is going on at a good pace. He was apprised about all the changes being made in these room. The last date is 7th October, 2015.

·       The proposal for a IMA Club on 3rd floor was explained to him. This project is still in  pipeline.

·       AKN Sinha Institute Auditorium - the plans are to change the flooring and order for installation of new chairs has been placed.

·       New office furniture has been ordered for Ground Floor office complex. Similar furniture will be placed in two rooms adjacent to National President office on 1st floor.

·       A new lift is planned as this is erratic in working. Tenders for the same be sought.

·       He was taken around the part of the building which has been given on rent to ARTH Business News Channel.

·       Office of APHI has been shifted from Ground Floor, in eastern part of the building, to the place where Honorary Secretary General and his staff was sitting till last month.

·       A new generator of 82.5 KVA is to be provided to ARTH by IMA. Tenders are sought.

·       The boundary wall needs to be changed for security reasons. The flooring of the area for parking is also to be changed. Outside the rented portion, there is a lot of leakage which has to be repaired.

·       Synergy has been given rooftop right for 4G Tower of Reliance. Discussion for maintenance etc. of complete rooftop are in progress.

As per the above decisions, following renovations have been made in IMA Building at New Delhi

5th Floor:-

  • The work of renovation of all the rooms is over. 
  • New beds, mattresses, curtains, bathrooms have been put up. 
  • New paint has been done.
  • Work in Room No. 507 will be over in another 10 days.

4th Floor:-

The renovation is over and in each room, there are 3-4 beds with all new furnishings.

3rd Floor:

There is a proposal for making 3-Committee/Conference Rooms at 3rd Floor, the map for which has been submitted  and it is expected that the work will be over within 3 months.

2nd Floor:-

IMA Club/Dinning Hall with all ultra modern furniture, billiard room etc. is planned at 2nd floor of the IMA Building.  The work for the same will be started soon.

1st Floor:-

AKN Sinha Auditorium:

  • The Flooring, Chairs and stage etc.  have been newly installed. 
  • Work is on to make it a modern auditorium with latest screening/theatre facilities in near future.
  • New office furniture was installed at two rooms (NP Secretariat) at 1st Floor. New storage almirah have also been installed in these rooms.
  • Renovation at Main Hall is also planned and modern screening facilities are also planned for the main hall.

Ground Floor:

  • New office furniture in 4 rooms (HSG Secretariat) at Ground Floor was installed. New storage almirah have also been installed in these rooms.
  • The secretariat of NP & HSG at 1st & Ground Floors are now much swankier.
  • New Lift is planned.  The tender for the same is being sought.
  • New Generator for 82 KVA is to be provided to M/s. ARTH by IMA.  The tenders for the same are being floated.
  • Boundary Wall needs to be changed for the security reasons.
  • The flooring of the parking area also needs to be changed
  • The outside area which has been rented out to M/s ARTH, there is a leakage in the building, which needs to be repaired. Tenders for the same are also being sought.
  • Two Porta Cabins have been installed in the western part of the building.  They are being used for the coaching of National Skill Development Corporation under Pradhan Mantri Kaushal Yojna.
  • New tower for 4-G Services of Reliance has been allotted to Ms/ Synergy.  Discussion for maintenance etc. of complete roof top are also in progress.
  • Office of AHPI at Ground Floor : This office of AHPI has been shifted in the eastern part of IMA Building to the place where HSG and his staff were sitting till now.
  • The eastern half of the building has been given on lease to M/s. ARTH.  Total area 5000 Sq ft.  has been given to them @ Rs.  8 lakh + Tax per month through an Memorandum of Understanding between IMA & ARTH.

 

  1. Leakage of all toilets has been taken care of.
  1. IMA HQ. is maintaining its canteen with its own staff and we have an understanding with OYO for renting out some rooms on 4th & 5th Floors of IMA Building.

An amount of Rs.69.07 Lakh has been incurred on the above renovations duly passed by the National President, Hony. Finance Secretary, Chairman of Building/Finance Standing.

Further, as per the decision of the 214th meeting of CWC held at Thiruvananthapuram on Sept. 19-20, 2015, agreement with M/s. C.K. Associates was terminated from 1st May, 2015. A trial agreement with Hotel Clark 1589 was made. A new Agreement was made ARTH Business News Channel was made from 1st October, 2015.

Also, the decision relating to rent agreement with Arth Business Centre was duly approved and passed in Central Council Meeting of 2015 and thereafter in 2017 Central Council i.e. in 78th Meeting of Central Council of IMA, the decisions relating to building final was clearly mentioned in Agenda Paper No. 2 at page no. 43 to 46 in which it is specifically mentioned that the agreement with Arth Business Centre was executed on 01.10.2015 and also it was clearly mentioned about the visits of Dr. S. N. P. Singh.

Thus, in view of the above, the decision of executing and entering into the rent agreement with Arth Business Centre was duly approved and resolved by CWC and CC of IMA and accordingly.

Further, it is important to mention herein that in IMA it is a custom of entering into rent agreement without getting the said rent agreement registered. Accordingly, all agreements the same system was followed.

It is important to mention herein that time and again the status of various legal cases both pending and decided have been duly informed and published in agenda of CWC and CC meetings of IMA.

In 78th IMA Central Council Meeting in the month of December, 2017 in Mumbai also it was duly informed and published in Agenda Papers on page No. 71 that:

            “Minutes of the meeting of Finance Standing Committee and Building Standing Committee of IMA held on 22nd September, 2017 at New Delhi

IMA Building related issue:

Regarding repair of IMA Hqs Building at Kolkatta a committee consisting of Dr Bakulesh S Mehta, Dr RN Tandon, Dr VK Monga, Dr Santosh Kumar Mandal and Dr Ashwani Dalamiya is constituted to look into the issues and come back with possible suggestions within 4 weeks.

  • Regarding the issue of non payment of rent by one of the tenants of IMA Hqs M/s. Arth Business News Channel, the House was informed the matter is subjudice.
  • Installatio of new lift at IMA Hqs. Professional service, provided as suggested by Dr. Lel, Mr. Tilak to look into the feasibility study for installation of new lift at IMA Hqs.

The meeting ended with vote o thank to the Chair. “

Further, the status of legal cases was also duly informed and communicated to all members of IMA vide email dated 19.12.2017 in which it was specifically mentioned that:

“The matter titled as "IMA versus Arth Business Centre" CS(Comm.) No. 122/2017 has been filed by IMA Hq. against Arth Business Centre for recovery of arrears of rent and damages was filed and was listed for hearing before Hon'ble High Court of Delhi on 12.07.2017 Mr. Rahul Gupta, Mr. Shekhar Gupta and Ms. Ira Gupta, Advocates have appeared on behalf of IMA. Notice to the defendant namely Arth Business Centre  has been issued by the Hon'ble High Court of Delhi but Arth Business is deliberately avoiding the service of summons. On 06.09.2017 and 28.11.2017, Mr. Shekhar Gupta and Ms. Ira Gupta, advocates had appeared and had requested the court to serve the defendant by way of email also. The service has been done through email and other modes. The next date of hearing is 03.01.2018.”

The 3rd floor of IMA building is rented out to QCI from August 2016 on annual contract of Rs. 4 Lacs per month.

The roof of IMA is given on rent to M/s. Synergy from Feb. 2016 for annual rent of Rs. 3 lacs.

12. Why members have been kept in darkness regarding JIMA? Learnt that due to long gap of 3 years, JIMA faced problems when restarted printing as the regular Advertisers disassociated,  it was in February, when Budgets of all the Pharma Houses were exhausted, no HFC given, Postal Department refused to give postage facilities, Central Government projects were withdraws, Nirman Bhavan told that IMA HQ requested to give the projects to HQ Publications & not to JIMA & many others. Members witnessed the Employership attitudes of Immediate Past President in regularly shouting at their colleagues of JIMA in several Meetings? Members want to know what cooperation he rendered to JIMA to make it viable once again. Is it really true that at the back of the mind of that HONEST Leader there is a strong intention of taking JIMA to his own Publication House?

Answer: JIMA is currently run by a JIMA committee and not by IMA head-quarters.

13. What steps have been taken to make other Publications of IMA, eg, Apka Swasthya, Your Health viable?

Answer: These are independent wings of IMA and IMA Hq is not involved in their management and working.

14: What special attentions were given to several wings if WMA by him?

Answer: These are independent wings under control of a National Chairman IMA wings and reports to CWC and CC.

15. Why out Leader of the Leaders, Immediate Past President of WMA, Dr Ketan Desai has been embarrassed by him several times directly or indirectly for many reasons.

Dr Desai is THE TALLEST LEADER of the medical profession and no one can embarrass him.

16. Which CWC/CC meeting approved the decision of putting personal photograph of that SPIRITUAL Leader in several Advertisements published in Times of India & Hindustan Times?

Answer: Only office-bearers photographs were included in the official advertisements.

17. So far, we remember, in his first Presidential Speech, immediately after taking over, he told he would not take a single Rupee from IMA for his travel expenses? Has it been maintained?

Answer: IMA regular budget has not spent a single rupee on me or any other office bearer in last three years.  Also, nothing is written in my presidential speech. This was said by me when I took over as HSG and not NP.

18. When he was HSG, he used to speak in the Meetings keeping the President almost as silent spectator. When he became National President, he did the same keeping the HSG silent. Is IMA constitution permitting so? Does Constitution give power to PERSON instead of Chair?

Answer: President is on the chair and always starts the meeting with Presidential address.

19. Was he trying to make our beloved Association an ownership Company?

Answer: IMA is a registered society which has been duly registered as per the provisions of Societies Registration Act, 1860 and being the registered society IMA has its own Memorandum, Rules and Bye-laws. IMA work as per the provisions of its Memorandum, Rules and Bye-laws and accordingly, IMA is run by CWC and CC i.e. by all the members of IMA and not by any one individual or member.

20. If we can shout against the unconstitutional Tirumala Trust openly to establish Transparency, then who not against so many irregularities?

Answer: Trimula Trust issue was raised by a Past National President and the National President on chair at that time constituted a committee. I was only a member secretary of the committee. I was not any decision maker in the committee.
